1.1 Amanda Stoneham respects your right to privacy and is committed to safeguarding the privacy of our clients, customers, members and website visitors. We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). This policy sets out how we collect, use, store and disclose your personal information.

1.2 "Personal information" means information or an opinion that identifies, or could reasonably identify, an individual.

2. Collection of personal information

2.1 Amanda Stoneham may collect and store personal information that you provide through our website, booking forms, questionnaires, workshops, memberships, consultations, social media platforms, email communications, online courses, digital products, or when engaging our services.

2.2 You may provide information including your name, business name, phone number, address, email address, social media handles and other information necessary for us to provide our services and communicate with you.

2.3 Depending on the service provided, we may also collect additional information including:

  • Information about your business, brand, products or services

  • Photography session preferences and requirements

  • Content planning information

  • Workshop registrations and attendance details

  • Membership registrations and participation details

  • Payment and billing information

  • Feedback, testimonials or survey responses

  • Information submitted through enquiries, forms or customer support requests

2.4 We may also collect any other information you voluntarily provide while interacting with us.

These Terms & Conditions govern the use of this website, the purchase of products and services, and participation in any programs, workshops, memberships, events, photography sessions, coaching, consulting, educational services, digital products and resources offered by Amanda Stoneham ("Amanda", "we", "our", or "us").

By accessing this website, purchasing a product, booking a service, attending an event, or participating in any program, you agree to be bound by these Terms & Conditions.

 

1. Definitions

Client means any individual, business, organisation or entity purchasing or participating in services or products provided by Amanda Stoneham.

Services include but are not limited to:

  • Personal branding photography

  • Headshot photography

  • Social media strategy sessions

  • Workshops and training events

  • Membership programs

  • Online courses and educational programs

  • Digital products and downloads

  • Content reviews and audits

  • GPT Core Files and AI-assisted resources

  • Consulting and mentoring services

  • Any other products or services offered by Amanda Stoneham

Website means amandastoneham.com and any related websites, landing pages or online platforms operated by Amanda Stoneham.

 

2. Bookings and Purchases

Bookings are confirmed once payment or any required deposit has been received.

For services requiring a deposit, the deposit amount will be specified at the time of booking.

Amanda Stoneham reserves the right to refuse or cancel any booking where payment has not been received.

All prices are listed in Australian Dollars (AUD) unless otherwise stated.

3. Payment Terms

Full payment may be required prior to commencement of some services.

Payment plans may be offered at Amanda Stoneham's discretion.

Where payment plans are provided:

  • Payments must be made on the agreed dates.

  • Failure to make payments may result in suspension or cancellation of access to services, programs, memberships, courses, downloads or resources.

  • Outstanding balances remain payable.

 

4. Workshops, Events and Training

Workshop and event registrations are non-transferable unless otherwise agreed in writing.

If you are unable to attend a workshop or event:

  • More than 48 hours notice may be eligible for transfer to a future event at Amanda Stoneham's discretion.

  • Less than 48 hours notice may result in forfeiture of fees paid.

If Amanda Stoneham is required to cancel or reschedule an event, participants will be offered a transfer to a future date or a refund at Amanda Stoneham's discretion.

Amanda Stoneham is not responsible for travel expenses, accommodation costs, loss of income or any other expenses incurred by attendees.

 

5. Photography Sessions

Session dates are secured upon payment of any required booking fee or deposit.

Clients are responsible for arriving on time and prepared for their session.

Amanda Stoneham is not responsible for outcomes affected by circumstances beyond reasonable control including weather conditions, venue restrictions, illness, traffic delays, client lateness or third-party providers.

The number of images, inclusions, deliverables and bonuses provided will be those outlined in the package booked at the time of purchase.

Image delivery timeframes are estimates and may vary during busy periods.

Unless otherwise specified, final images will be delivered digitally.

 

6. Rescheduling and Cancellations

Requests to reschedule must be made as early as possible.

For photography sessions, a minimum of five (5) days' notice is required for rescheduling.

One reschedule due to illness or genuine unforeseen circumstances may be permitted at Amanda Stoneham's discretion.

Repeated rescheduling requests may result in cancellation of the booking and forfeiture of fees paid.

Photography session cancellations made with less than 24 hours' notice may incur a fee to cover lost booking time, preparation, studio hire, travel, third-party expenses or other costs incurred.

If Amanda Stoneham is unable to provide services due to illness, emergency or circumstances beyond reasonable control, every effort will be made to reschedule the booking or provide an alternative solution where possible.

 

7. Memberships

Membership fees are charged according to the selected membership plan.

Monthly memberships automatically renew unless cancelled at least fourteen (14) days prior to the next billing date.

Annual memberships renew according to the selected payment arrangement and any notice requirements outlined in the Membership Agreement.

Membership cancellations requested less than fourteen (14) days before the next billing date may result in the next payment being processed before cancellation takes effect.

Amanda Stoneham reserves the right to update membership inclusions, resources, guest experts, delivery methods, pricing or community platforms provided the overall value of the membership remains substantially similar.

Membership access is for the registered member only and may not be shared.

8. Online Courses, Digital Products and GPT Core Files

Due to the digital nature of these products, no refunds will be given for change of mind. Refunds for faulty or not fit-for-purpose goods will be considered in accordance with Australian Consumer Laws

 

9. Educational Disclaimer

Amanda Stoneham provides education, training, mentoring, strategy and guidance.

Results vary between individuals and businesses.

No guarantees are made regarding:

  • Income

  • Sales

  • Business growth

  • Social media reach

  • Engagement

  • Leads

  • Client enquiries

  • Specific outcomes

Clients are responsible for implementing any advice, recommendations or training provided.

10. Artificial Intelligence (AI)

Amanda Stoneham may use AI-assisted tools, including language models and content-generation technology, to support research, planning, content development, strategy, training materials and GPT Core File creation.

While reasonable care is taken, clients acknowledge that AI-generated information may occasionally contain inaccuracies and should be reviewed before implementation.

Clients remain responsible for any decisions made using AI-assisted materials.

 

11. Copyright and Intellectual Property

All content created by Amanda Stoneham remains the intellectual property of Amanda Stoneham unless otherwise agreed in writing.

This includes:

  • Photographs

  • Training materials

  • Workshops

  • Presentations

  • Course content

  • Templates

  • Digital products

  • GPT Core Files

  • Membership resources

  • Written content

Clients may not reproduce, sell, distribute, modify, teach from, or repurpose these materials without written permission.

 

12. Photography Copyright and Image Use

Amanda Stoneham retains copyright in all images created.

Clients receive a non-exclusive licence to use purchased images for personal use and business marketing purposes.

Images may be used for:

  • Personal use

  • Marketing and promotional purposes for the Client's own business or brand

  • Website content

  • Social media content

  • Printed marketing materials

Images may not be:

  • Sold

  • Licensed to third parties

  • Resold

  • Used by another business or organisation

  • Altered substantially beyond standard cropping, resizing or platform formatting

  • Used for commercial resale

without prior written permission from Amanda Stoneham.

 

13. Promotional Use and Model Release

Unless otherwise advised in writing, clients grant Amanda Stoneham an irrevocable, perpetual, worldwide, royalty-free licence to use images, testimonials, workshop feedback and project examples for promotional, marketing, educational and business purposes including, but not limited to:

  • Marketing and advertising

  • Social media

  • Website content

  • Portfolios

  • Educational materials

  • Promotional materials

  • Award submissions

  • Competition entries

  • Publications

  • Media features

  • Speaking engagements

  • Printed displays and exhibitions

If a client does not wish their images or content to be used, they must advise Amanda Stoneham in writing prior to publication.

No compensation will be payable for such use.

14. Limitation of Liability

To the maximum extent permitted by law, Amanda Stoneham shall not be liable for:

  • Indirect or consequential loss

  • Loss of profits

  • Business interruption

  • Loss of data

  • Loss of opportunity

arising from the use of services, products, resources, advice, photographs or training.

Where liability cannot be excluded, liability is limited to the amount paid by the Client for the relevant service or product.

 

15. Privacy

Personal information is handled in accordance with our Privacy Policy.

By engaging with Amanda Stoneham, you consent to the collection, storage and use of information as outlined in that policy.

 

16. Website Use

Users must not:

  • Copy content without permission

  • Attempt to interfere with website functionality

  • Use website content for unlawful purposes

  • Misrepresent affiliation with Amanda Stoneham

 

17. Amendments

Amanda Stoneham reserves the right to amend these Terms & Conditions at any time.

Updated versions will be published on the website and become effective immediately upon publication.

 

18. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia.

Any disputes arising in connection with these Terms & Conditions shall be subject to the jurisdiction of the courts of Victoria, Australia.
